Due process and rights of the accused, impartiality of criminal justice, homicide rates and democracy index as factors of democratic rule of law and their erosion in Brazil between 2012 and 2023

Abstract

 the democratic rule of law is a complex concept with many defined bases. In Political Science, it is a valuable and fundamental concept of contemporary democracies. In addition to free and fair elections, the democratic rule of law adjusts political regimes to the mechanism of checks and balances, guarantees of individual freedoms and accountability. In this analysis, we will seek to shed light on some fundamental elements of the concept of a democratic rule of law with some proxy indicators, namely: the legal process and the rights of the accused, the impartiality of criminal justice, homicide rates and the democracy index. Measuring them and diagnosing their correlations. The methodology used was descriptive statistics, using demonstration between data matrices with analysis of the levels of association between the indicators that make up the democratic rule of law in our approach. The results pointed to significant levels of association between the terms, with emphasis on the high statistics between the impartiality of criminal justice and the level of democracy in Brazil.
