Legality and legitimacy of the legislative process in the democratic state: a discussion about Jürgen Habermas's public sphere and Nancy Fraser's symbolic order

The present work aims to analyze whether legality can be considered a consequence of the legitimacy of the legislative process in the Democratic State. To answer this question, based on the hypothetical-deductive method, through a bibliographical review, this article is based on the deliberative policy proposed by Habermas, as a construction of the discursive dialogue of the citizens' opinion and will, based on a critical reflection of the contributions by Nancy Fraser on the symbolic order of systems of domination. Based on this investigation, the main result is that assuming a legitimate process that welcomes everyone equally is an ideal that has not yet been achieved.
