Notas introdutórias e contribuição histórica da doutrina do precedente

O ambiente histórico e normativo das tradições do common law é muito distinto do ambiente histórico e normativo de nossa tradição jurídica. O que contemplamos, nesse sentido, é um esforço para acomodação, entre nós, de arranjos e institutos construídos em ambiente distinto do nosso. Essa constatação não significa, necessariamente, que ideias e arranjos não possam circular entre os vários países, inclusive com tradições distintas. O que sugere, é que há uma necessidade de adaptação, que pode variar, a ponto da feição original de determinado instituto mostrar-se substancialmente alterada no contexto histórico e político que a recebeu. De tal modo, concluímos, o estudo de institutos novos (amigo da Corte, precedente, entre outros) sugere que se estude, concomitantemente, os ambientes históricos nos quais foram construídos. Essa pode ser, provavelmente, a tarefa prática mais emblemática do direito comparado.
