A influência do legado aristotélico-tomista na concepção da lei em Marsílio de Pádua

No contexto dos conflitos entre Império e Igreja na Idade Média, Marsílio de Pádua representou a mais radical oposição ao sistema teológico-político em vigor, formulando uma teoria laica do poder. Neste artigo, estudamos a formaçãodo conceito de lei no pensamento de Marsílio de Pádua, a partir da obra “O Defensor da Paz”, situando-o historicamente no contexto dos conflitos entre o poder régio e o papal; analisando as correntes que o determinaram, especialmente a teoria do direito natural aristotélico-tomista, o que servirá de base para
a formulação da teoria do Estado secularizado ou soberania popular no pensador Paduano, que reflete no pensamento moderno.
