Legal Education and Research Methodology: challenges of contemporary training

Abstract

This essay analyzes the transformations of contemporary legal education, identifying three fundamental approaches: the formation of habitus, the transmission of technical knowledge, and the development of skills in research methodology. The formation of legal habitus occurs through students' immersion in legal culture, which allows for the incorporation of collective symbolic repertoires into individual sensibilities. The transmission of technical knowledge, traditionally carried out by legal doctrine, consists in the systematized learning of the knowledge that governs the formulation of legal discourses. The text identifies a crisis in the traditional “doctrinocentric” Brazilian legal culture, caused by the heterogeneity of values in contemporary society and the technological transformations that have allowed universal access to judicial decisions. This crisis highlights the need to incorporate research methodology into legal education, as this skill emerges as an essential component for training jurists both to produce rigorous knowledge and to incorporate empirical knowledge into professional practice.
