Abstract

ABSTRACT

 

What are the origins of humanist penal mediation? This approach was developed within the framework of specific training that was created to give mediators the skills essential to their role. Thus penal mediation was able to provide responses other than those offered in the context of legal action, because they better met, in some cases, the expectations of the plaintiffs. Justice, through mediation, was thus able to sow seeds of humanity at a crucial moment in the journey of individuals. Thus mediation tries to sow seeds of humanity by educating and uplifting citizens and particularly young people. It invites them to discover that they have the capacity to change and that they alone are responsible for their future, like the mediator himself who always keeps the awareness of the humility of his position because he too is in a way to best fulfill his human destiny.

Author Biography

  • Jacqueline Morineau, Centre de Mediation et Formation à la Médiation

    After studying Classical Archeology she specialized in Greek Numismatics, becoming a researcher at the British Museum in London. From her knowledge of the ancient world derives the essential tools to develop an original "social" intervention project, based on mediation and the training of the mediator. Jacqueline founded (1984) and directs in Paris, the CMFM - Center de Médiation et de Formation à la Médiation, which was commissioned (1984) to implement the first experiment in criminal mediation for the Paris court prosecutor's office. To date, the CMFM has carried out over 7000 mediations in the fields: criminal, social, family, school.
    Morineau has designed and implemented, with the patronage of UNESCO, a pilot experience, conducted in French schools. You have created a mediation program for Young Europeans in the Council of Europe and a European Association of Young Mediators. You are in charge of a Peace Mediation project in the Balkans.
