Abstract


O presente estudo apresenta uma reflexão sobre a concepção de sujeito de
direito formulada por Paul Ricoeur, com intuito de oferecer elementos para pensar
o desenvolvimento do caráter democrático da atividade jurisdicional do
Estado Brasileiro. Discorre-se sobre as características do regime democrático
adotado pela Constituição de 1988, marcado pelos princípios participativo e
pluralista. Expõe-se, segundo Ricoeur, uma perspectiva de sujeito de direito
enquanto aquele capaz de enunciar-se, compreendendo o outro como um outro
eu, num contexto institucionalmente mediado. Relaciona-se essa idéia ao princípio
constitucional democrático. Propõe-se uma abordagem da jurisdição democrática
como um espaço institucional de enunciação do sujeito de direito.
